Creekside Health Lawsuit Seeks Damages for Wrongful Death

The Creekside Health lawsuit was filed on January 22, 2025 in the Twelfth Judicial Circuit Court in and for Sarasota County. According to the complaint, the resident sought services from the nursing home “following a traumatic motor vehicle collision which resulted in both a brain bleed and a fractured neck” and that he relied on staff for assistance.
The lawsuit further alleges that the nursing home “failed to provide any monitoring or fall prevention mitigation strategies” to protect the resident, and as a result, he “attempted to get out of his bed on his own and fell causing significant and severe injuries and death.”
The lawsuit remains open and pending at this time. Attorneys for the nursing home have filed an answer and defenses and have moved to dismiss part of the complaint.
