Aspire at Beneva Lawsuit Alleges Negligence and Resident Rights Violations

The Aspire at Beneva lawsuit was brought by the personal representative of a former deceased resident’s estate against the nursing home. The lawsuit alleges that the former resident suffered “the development and deterioration of wounds” during his admission and that the nursing home failed to “prevent skin breakdown due to continual contact with feces and urine.”
The lawsuit seeks damages for loss of dignity, pain and suffering, mental anguish and also wrongful death damages for this gentleman’s survivors.
Pressure injuries, or “bed sores” as they are commonly known, are generally caused by unrelieved pressure to the skin. They frequently occur on a resident’s backside, heels, hips and other bony prominences. Skin breakdown can occur in a matter of hours. If a person is left to lie in their own urine and feces, skin breakdown can occur quite rapidly. Under these circumstances, infection is also always a major concern.
The recent lawsuit filed against Aspire at Beneva remains open and pending in the Twelfth Judicial Circuit Court at this time. The Florida Agency for Health Care Administration licenses, inspects and penalizes nursing homes when appropriate.
