
A Brookdale Deer Creek lawsuit alleged that a resident and her caretaker operating under a power of attorney failed to pay monthly fees owed in accordance with the assisted living facility’s contract and residency agreement. Brookdale Senior Living Communities, Inc. is the operating company that does business under the fictitious name of “Brookdale Deer Creek,” a for-profit 38-bed ALF located at 8450 McIntosh Road, Sarasota, Florida 34238. This corporation also operates a number of other assisted living facilities in Sarasota County as well as a nursing home, a couple of which have been sued for negligence in lawsuits.
Brookdale Deer Creek complaints have brought investigators into the ALF over the past few years to conduct inspections. Most recently, On February 13, 2025, Brookdale Deer Creek was the subject of an unannounced inspection that resulted with the State of Florida Agency for Health Care Administration issuing a total of nine (9) deficiencies against the facility. A deficiency represents by the State of Florida that an ALF has failed to comply with the requirements of Florida law. Brookdale Senior Living Communities, Inc. Sued Twice
While a single Brookdale Deer Creek lawsuit sought damages for eviction and unlawful detainer and possession of premises, it does not appear that this ALF has been sued for negligence. That is not true, however, for other facilities in Sarasota County owned and operated by Brookdale Senior Living Communities, Inc.
Two lawsuits have been filed against Brookdale Senior Living Communities, Inc. involving its facilities in Sarasota County asserting claims for negligence. Both of these lawsuits were resolved and are closed at this time. Of course, cases for negligence may be brought and settled with a corporation before a lawsuit is ever filed.
