Brookdale Phillippi Creek is a for-profit 127-bed assisted living facility located at 5501 Swift Road, Sarasota, Florida 34231. Brea Sarasota LLC is the company that holds the license to operate Brookdale Phillippi Creek. Records on file with the Sarasota Clerk of Court reveals that Brea Sarasota LLC has been a party in fourteen different lawsuits. In ten of those cases, it was named as a defendant in negligence lawsuits involving resident care. This is well above the average for the number of lawsuits filed against assisted living facilities in Sarasota County, Florida.
Update as of November, 2025:
Inspectors with the Florida Agency for Health Care Administration cited Brookdale Phillippi Creek with four (4) deficiencies in June, August and October of 2025. The ALF was found to have failed to comply with elopement standards set forth under Florida law. Specifically, requirements were not met for five out of six residents who were identified by staff as being an elopement risk. Elopement occurs when a resident wanders away, undetectedly, from an assisted living facility, often posing great danger to a confused, elderly individual. Florida investigators concluded that the facility failed to ensure that those five residents had identification on their person that included their name and the facility’s name, address and telephone number. This resulted in the issuance of a Class III deficiency. The other deficiencies cited involve failures related to the requirement to properly and timely report adverse incidents to the State of Florida.
Brookdale Phillippi Creek Lawsuits Alleged Negligence
The two most recent lawsuits filed against the company that operates Brookdale Phillippi Creek sought damages for the wrongful death of residents at the facility.
In each lawsuit, the representatives of the former residents alleged that staff at Brookdale Phillippi Creek violated their resident rights under Florida law. The lawsuits sought damages for not only wrongful death, but additionally, bodily injury, pain and suffering and loss of capacity for the enjoyment of life. Both of these lawsuits have been resolved by the parties and are now closed.
Brookdale Phillippi Creek Complaint Results in Deficiencies
The most recently published inspection report for Brookdale Phillippi Creek reveals that the ALF was cited for multiple deficiencies that were discovered by Florida officials during a complaint investigation. Brookdale Phillippi Creek was cited for failing to meet requirements under Florida law relating to resident care – supervision, resident care – elopement standards, medication – assistance with self administration, staffing standards, training, food service – dietary standards and background screening of employees.
