A total of three Birchwood Health lawsuits alleging negligence and violations of residents rights were filed against the Sarasota nursing home and its corporate operator during 2025. Birchwood Health and Rehabilitation Center is a for-profit 87-bed facility located at 3250 12th Street, Sarasota, Florida 34237.
In addition to facing these lawsuits, the nursing home and its corporate operator received numerous complaints in 2025 that were investigated by officials with the Florida Agency for Health Care Administration. As of December, 2025, Birchwood Health and Rehabilitation Center remains on the Florida “Nursing Home Watch List.”
Birchwood Health Lawsuits Remain Pending
In the first lawsuit, the nursing home and its staff are alleged to have permitted a female resident to suffer falls, unexplained injuries, respiratory failure and death. The negligence lawsuit seeks damages for her wrongful death against the nursing home’s operator.
The second lawsuit against Birchwood Health and Rehabilitation Center also seeks damages for the wrongful death of a female resident. The complaint alleges that the nursing home failed to “implement appropriate skin care and pressure wound interventions during the residency” and were also negligent in allowing her to suffer falls. As a result, she is alleged to have “passed away from the injuries she suffered at Birchwood Health and Rehabilitation Center.”
In the third lawsuit, filed just recently in November, 2025, a female resident was alleged to have been “abused and neglected at Birchwood Health and Rehabilitation Center.” The nursing home’s negligence is alleged to have caused her to suffer “skin breakdown leading to pressure wounds.” Damages are being sought for, among other things, the resident’s pain and suffering, mental anguish, hospital expenses and medical and nurisng care.
All three cases were filed in the Circuit Court in and for Sarasota County, Florida and remain open and pending at this time.
Birchwood Health and Rehab Complaints Result in Investigations, Deficiencies and Fines
Complaints brought state investigators to this Sarasota nursing home three different times during 2025. As of December of this year, Birchwood Health and Rehab was cited with a total of four deficiencies. A total of $11,500.00 in fines were imposed against the nursing home in 2025 as well based on its history of violations. The most recent violations focused on the failure to meet requirements relating to residents rights. Specifically, the nursing home was found in non-compliance with state and federal laws concerning its duties to provide residents with living quarters that are free of accident hazards and with adequate supervision, the right to receive adequate and appropriate healthcare, and the right to live in a safe, clean, decent and homelike environment.
