Located at 18400 Cochran Boulevard in Port Charlotte, FL, Village Place Retirement is a for-profit 114 bed assisted living facility or “ALF.” This particular ALF is part of a chain of assisted living facilities owned or operated by Holiday Retirement. Village Place Retirement has a license to provide limited nursing services. It is important to note, however, that this does not mean that 24 / 7 nursing care is provided like you would find in a nursing home. Unfortunately, assisted living abuse can exist in many forms.
Village Place Retirement faced lawsuit complaint alleging negligence resulting in a fall, hip fracture and wrongful death
A lawsuit was filed against the limited liability company alleged to be doing business as Village Place Retirement in Port Charlotte. The lawsuit complaint alleged that a resident was not supervised or assisted and allowed to experience a “catastrophic fall” that resulted in her suffering a fractured hip. Ultimately, this poor lady died. Studies have shown there is a substantially increased rate of mortality following a fall and hip fracture in the elderly.
When any assisted living facility lacks enough staff to monitor, supervise and assist its residents, you are going to have problems, accidents and injuries. This seems like common sense. When an assisted living facility corporation knows this fact but consciously fails to hire and employ sufficient staff to meet the needs of its residents, this constitutes assisted living facility abuse. Village Place Retirement assisted living facility in Port Charlotte was cited for deficiencies by the Florida Agency for Healthcare Administration following an unannounced inspection during 2017
In April of 2017, state investigators employed by the Florida Agency for Healthcare Administration performed a survey investigation at Village Place Retirement assisted living facility. Their surprise investigation resulted in Village Place Retirement receiving citations for violating Florida law. These citations are known as deficiencies. Florida assisted living residents are, by law, required to ensure their residents the right to live in a safe, clean, and decent homelike living environment. If the floor in an assisted living facility is damaged and needs repairs, it should be common sense that the damaged areas could cause a resident to fall and suffer serious injury or death.
The Florida investigators who conducted the investigation observed and reported that damage to the floor in Village Place Retirement’s secure unit posed a safety hazard to its residents; including damage to the floor that posed a tripping hazard to elderly residents using walkers. This section of Village Place Retirement also appeared dirty and damaged to investigators. As documented by state investigators: “The tile floor throughout the area was soiled with excessive dirt buildup in the corners. The door post [was] heavily scarred. The tile floor was observed to be heavily scared and large chipped areas. The wall near the entrance to the area was observed to have a hole [filled] but not painted. [T]he administrator said the green community on the 1st floor has some serious maintenance issues. She said the area is scheduled to be remodeled but corporate has not authorized the remodeling at this time.” One does not need to be an assisted living facility abuse lawyer in order to see the potential for harm and injury that could occur in light of these types of hazards. Village Place Retirement was not required to pay any fines or penalties as a result of these documented problems.
