A Banyan Residence in Venice Cited for Deficiencies December, 2015

A Banyan Residence Assisted Living Facility in Venice Receives Safety Citations

Searching for an assisted living facility in Venice, Sarasota, Englewood or a surrounding community?  Assisted living facilities appear to be cropping up on almost every street corner.  Just in Venice alone, there are at least three new assisted living facilities or “ALFs” currently under construction.  When choosing an ALF, it is important to consider their track record, the staff to resident ratio, and the qualifications and experience of the “resident care coordinator” or house nurse.  In Florida, assisted living facilities are licensed, regulated and investigated by the Florida Agency for Healthcare Administration (AHCA).  These AHCA investigations occur without advance notice or warning.  Upon arriving, the AHCA team of investigators, known as surveyors, determine whether the facility is in compliance with the minimum standards for ALFs pertaining to resident care.

On December 7, 2015, the State of Florida Agency for Healthcare Administration conducted an unannounced investigation at A Banyan Residence, which is located at 100 Base Avenue East, Venice, Florida 34285.  At that time, state investigators cited A Banyan Residence for failing to meet the standards set forth for assisted living facilities under Florida Statute Chapter 429 and Florida’s Administrative Code.

Deficiencies Involve Cleanliness and Medication Issues

Those citations of deficiencies against A Banyan Residence included:

0030           Failing to maintain a clean environment for residents.

0054           Failing to document missed doses of medication and the reason for the missed doses of medication.

0055           Failing to dispose of expired medication within 30 days.

0056           Failing to have medications filled in a timely manner.

The complete survey investigation is available for review at AHCA’s website: www.floridahealthfinder.gov.  Local Venice Assisted Living Facility Abuse and Neglect lawyer, James Keim, seeks to hold those ALFs accountable for the serious harm they cause by failing to follow the law and neglecting and abusing the most frail and vulnerable citizens in Florida which they are obligated to protect.  Remember to always decline, cross out and say “ no thanks” to arbitration clauses contained within assisted living facility admissions agreements.  Signing an arbitration clause will cause you to waive important constitutional and legal rights.
