North Port Retirement Center complaints lawsuits reviews

North Port Retirement Center complaints were investigated at this assisted living facility during 2025 at the same time as the occurrence of its relicensure inspection. The facility is a for-profit 50-bed ALF located at 4950 Pocatella Avenue, North Port, Florida.

All assisted living facilities in Florida are required to be inspected as part of their biennial relicensure. Those inspections occur on an unannounced basis and are conducted by officials with the Agency for Health Care Administration. In 2025, North Port Retirement Center was the subject of complaints. The State of Florida investigated those complaints during the same time as it conducted its inspection for purposes of the facility’s license renewal.

While Florida inspectors were unable to substantiate the two separate complaints that were received about North Port Retirement Center, they did discover other areas of non-compliance with Florida law during their investigation. A total of three (3) violations were discovered during the inspection and the liicense-holder was cited with three Class III deficiencies as a result.

The deficiencies cited related to failures in the areas of: 1) resident care – elopement standards, 2) medication records and 3) Alzheimer disease / dementia training. With regard to the failure to properly maintain resident medication records, investigators concluded that the law was not met because, based upon “observation, record review, and interview, the facility failed to accurately update the Medical Observation Record each time a medication” was given for two out of the four residents observed during the investigation.

A third complaint brought inspectors back to the facility for an inspection nearly two months after it completed its relicensure survey. Florida officials were also unable to substantiate that complaint, and no citations were issued at that time.

Administrative Lawsuit Previously Resulted in Imposition of Fine Based on “Unlicensed Activity”

Last year, the license-holder for this asissted living facility was required to pay a $5,000.00 fine following a 2023 inspection. During that inspection, Florida officials concluded that the facility was improperly providing assisted living services to residents within the independent living section of the building. The Agency for Health Care Administration cited North Port Retirement Center with a deficiency for “unlicensed activity.” Additionally, the State of Florida filed a type of lawsuit known as an “Administrative Complaint” seeking to impose a $5,000.00 fine as a penalty for the alleged violation of Florida law.
