Heritage Park Nursing Center most recently received a complaint that was investigated in December, 2023. The Florida Agency for Health Care Administration visited and inspected the nursing home at 2302 59th Street West, Bradenton, Florida 34209. At the time of the investigation, the Agency was not able to substantiate the allegations of the complaint. No deficiencies were issued at that time. Prior to that most recent inspection, however, Florida officials were in the building to conduct a standard inspection in October, 2023.
During that inspection, the investigative team observed and cited the nursing home with a total of eleven deficiencies. A deficiency constitutes a finding that a nursing home has failed to comply with requirements under state or federal law. In addition the laws of the State of Florida, nursing homes who receive Medicare payments must also comply with the federal Nursing Home Reform Act of 1987.
Heritage Park Nursing Center Violations Reported
At the time of the October, 2023 inspection, numerous violations involving quality of care were documented. Specifically, violations were cited in relation to quality of care, failing to follow physician orders, and failing to adhere to each resident’s right to receive adequate and appropriate health care. The Centers for Medicare and Medicaid Services rates nursing homes under its Five Star Quality Rating System. Currently, CMS has rated this nursing home with only “one star” or “much below average.” As a result of the inspection results, CMS has imposed a fine against the owner of the nursing home in the amount of $6,885.00.
Lawsuit Filed Against Nursing Home
A wrongful death lawsuit was filed in 2023 that named Heritage Park Nursing Center, LLC as a defendant. The complaint further alleged that a resident “suffered from abuse and neglect” at the location of this nursing home, along with “the development and worsening of pressure sores, poor hygiene, falls, infections, dehydration, malnutrition,” among other issues.
Chapter 400 of the Florida Statutes contains a provision that allows individuals, and the estates of deceased residents, to sue nursing homes in Florida to recover damages for for neglect, abuse, negligence, wrongful death, and the violation of a resident’s rights.
