A Windsor of Venice lawsuit reveals a rising trend in Florida with assisted living facility corporations: suing residents who fail to pay “room and board” charges. Windsor of Venice is a for-profit 94 bed assisted living facility located at 1600 Center Road, Venice FL 34292. In this case, the corporate license holder for Windsor of Venice filed a lawsuit in Sarasota County court seeking damages for allegedly unpaid charges assessed against an elderly lady who had vacated the premises. Not every assisted living corporation resorts to such extreme measures to collect unpaid bills. In fact, some assisted living lawyers would argue that filing a lawsuit against a resident is a very risky proposition. Why? Well, in the event the resident was justified in not paying the charges or was subjected to neglect or abuse, they could potentially file a counterclaim against the ALF. The Case is Not the Only Windsor of Venice Lawsuit Archived in Sarasota County Court Records
Previously, a lawsuit was brought against the license holder (Center ALF, LLC) and management company (Legend Senior Living, LLC) for Windsor of Venice. The complaint alleged that the assisted living facility was negligent in causing an elderly man to suffer falls, skin tears, bruising, a fracture, aspiration pneumonia, dehydration, malnutrition, and ultimately, his death. That lawsuit was settled in 2017.
In another case, a daughter sued Windsor of Venice because the facility failed to issue a refund of money that was paid to hold a room for her father. Her father passed away before he ever moved into the building. Despite this, Windsor of Venice allegedly not only failed to refund her deposit but also attempted to collect additional funds from her, personally, that the ALF ‘s administrator claimed were due.

Complaints at Windsor of Venice and inspections conducted at the assisted living facility have resulted in numerous citations of deficiencies. A deficiency is a finding by Florida investigators with the Agency for Health Care Administration of a failure to comply with Florida law.
