Public records on file with the Clerk of Court for the Twelfth Judicial Circuit, Sarasota County, reveal the existence of eight lawsuits involving the company that holds the license to operate Arden Courts of Sarasota. This company is known as Arden Courts of Sarasota FL LLC. Of these lawsuits, only one remains open and pending. This open lawsuit involves a case filed recently by the facility against a former resident and that resident’s “responsible party” to collect unpaid charges. Unfortunately, more and more assisted living corporations appear to be pursuing lawsuits against family members when an ALF resident runs out of money. By simply signing the resident into the facility as the “responsible party” on the company’s residency agreement, family members may be unwittingly subjecting themselves to personal liability if the ALF’s charges go unpaid. In this particular action, the ALF is suing to recover $38,192.87 for “contractual charges.” This highlights the need to read ALF contracts extremely carefully and to consult a lawyer in the event you do not fully understand the obligations under the “residency agreement.” The remaining seven lawsuits previously filed against the company that operates Arden Courts of Sarasota all alleged negligence. They have all been resolved and are closed at this time.
